rjinbc.ca is an independent community directory (“we”, “us”, “our”). These Terms of Use (“Terms”) govern your access to and use of the website and related services (collectively, the “Service”). The Service is offered as a non-commercial project to help people find restorative justice programs in British Columbia. These Terms are not legal advice. See also our Privacy Policy.
Agreement and changes
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. We may update these Terms from time to time; the “Last updated” date above will change when we do. Continued use after changes constitutes acceptance of the revised Terms.
The Service and eligibility
The Service provides a searchable directory of restorative justice programs and related information. Program listings may be submitted or managed by account holders after review. We do not provide restorative justice services, legal representation, counselling, referrals on an individual basis, or crisis support.
Accounts and security
Certain features require an account. You agree to provide accurate information, keep your credentials confidential, and notify us promptly (using the contact in our Privacy Policy) if you suspect unauthorized access. You are responsible for activity under your account.
Program listings and user content
Listings, corrections, claims, and other materials you submit (“User Content”) must be lawful, accurate to the best of your knowledge, and respectful. You retain any rights you have in your User Content, but you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute User Content as reasonably necessary to operate and improve the Service (including publishing approved directory entries).
We may refuse, edit, unpublish, or remove listings or accounts that we reasonably believe violate these Terms, mislead users, infringe rights, or create risk for the Service or the community.
Acceptable use
You agree not to:
- Use the Service in any way that violates applicable law or third-party rights.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Interfere with or disrupt the Service (including introducing malware or excessive automated traffic).
- Scrape or harvest data in a manner that degrades the Service or bypasses technical limits we apply.
- Use the Service to send spam, threats, harassment, or discriminatory content.
Directory information and third parties
Directory information is provided for general convenience only. We do not guarantee that listings are complete, current, accurate, or suitable for any purpose. A program’s inclusion does not constitute endorsement, partnership, or certification. Official processes, referrals, and eligibility are determined by programs and authorities—not by this website.
The Service may link to third-party websites or resources. We are not responsible for their content, practices, or availability.
Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by applicable law, we and our operators, contributors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim (if any), or (b) fifty Canadian dollars (CAD $50).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.
Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless us and our operators from claims, damages, losses, liabilities, and reasonable expenses arising directly out of User Content you submit that is unlawful or infringes third-party rights, or your deliberate misuse of the Service.
Termination
We may suspend or terminate access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or harms the Service or others. You may stop using the Service at any time. Provisions that by their nature should survive (including disclaimers, limitations of liability, and governing law) will survive termination.
Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to submit to the exclusive jurisdiction of the courts located in British Columbia for disputes arising out of or relating to these Terms or the Service, subject to any mandatory consumer protection rules that cannot be waived by contract.
